At NitiNyaya, we believe in the concept of “preventive litigation” and “preventive lawyering”. It is aptly said:

“Mediate and conciliate, don’t litigate.”

The disputes can be settled outside court by way of arbitration, mediation and conciliation.

What is the difference between Arbitration, Mediation and Conciliation?

Arbitration: Arbitration is a dispute settlement process in which an impartial third party is appointed to study the dispute and hear both the parties to arrive at a decision binding on both the parties. An arbitrator has the power to enforce his own decision. Prior agreement between the arbitrator and the party at dispute is required.

Mediation and Conciliation: In Mediation and Conciliation, a third party will assist in the process of problem solving. They do not have the power to enforce their own decisions. Prior agreement is not required.
